BISSESSUR is pleased to announce that Prenobe Bissessur has contributed the Netherlands chapter to the International Insolvency & Restructuring Review 2026/27, published by Beaumont Capital Markets.

The article, titled “The Dutch Route to Business Rescue: Why international companies should consider restructuring in the Netherlands”, explores the role of the Netherlands as a strategic restructuring venue for international companies facing financial distress.

In cross-border restructuring situations, the choice of venue can be as important as the restructuring strategy itself. International companies may have creditors, shareholders, assets, guarantees and financing arrangements spread across several jurisdictions. The article explains why the Netherlands, through the Dutch WHOA restructuring plan procedure, may offer a practical and effective route to preserve value, stabilize creditor pressure and implement a controlled restructuring where there is a sufficient Dutch connection.

The contribution discusses, among other topics:

  • why the Netherlands should be considered in the venue analysis for international restructurings;
  • what a Dutch restructuring plan under the WHOA can achieve;
  • the importance of debtor-in-possession restructuring;
  • how the WHOA may function as a powerful negotiation tool;
  • the balance between restructuring flexibility and creditor protection;
  • liquidity and funding considerations;
  • cross-border recognition and implementation; and
  • the importance of early action by management.

The article reflects BISSESSUR’s focus on corporate law, business restructuring, insolvency and cross-border stakeholder situations. With a presence at Schiphol-Amsterdam and in Zürich, BISSESSUR assists companies, directors, shareholders, creditors and investors in complex restructuring and distressed situations where Dutch law and international implementation need to be carefully aligned.

The International Insolvency & Restructuring Review 2026/27 includes contributions from leading restructuring professionals across multiple jurisdictions and provides insight into current developments in international insolvency and restructuring practice.
